PRIVACY POLICY

Proteccion Plenitud, LLC (DBA Assure for Life) (“Assure for Life”, “we”, “our” or “us”) provides family assistance membership plans, including funeral assistance services, throughout the United States. This Privacy Policy describes how we collect, use, disclose, and protect personal information. By using the Website or providing personal information to us, you acknowledge that you have been provided with this Privacy Policy.

This Privacy Policy applies to personal information we collect through any channel, including: our website at www.assureforlife.com, our mobile sites and applications, and any other digital platform we operate (collectively, the “Website”); the chat feature available on our Website; our customer service and sales call centers; our independent consultants, agents, and authorized agencies; our corporate (employer-provided) plan channel; text messages (SMS/MMS), WhatsApp, email, and telephone; paper or electronic enrollment forms; and promotional campaigns, surveys, contests, and sweepstakes.

1. Information We Collect

Depending on how you interact with us, we may collect the following categories of personal information:

  • Contact and identity data: name, membership number, date of birth, gender, mailing address, telephone number(s), and email address.
  • Family member and beneficiary data: names, dates of birth, and relationship to the primary member of the individuals included in a membership plan.
  • Payment data: payment card number, expiration date, bank account information, billing address, and payment history. Payment card data is processed through PCI-compliant payment processors; we do not store full card numbers on our own systems.
  • Enrollment and service data: plan type, plan options, enrollment date, payment status, service requests, and records of assistance services provided.
  • Employment data (corporate channel): if you are enrolled through an employer-provided plan, we receive from your employer the information reasonably required to enroll and administer you as a member, such as your name, contact information, date of birth, and employment status.
  • Consultant, agent, and agency data: if you apply to become or act as an independent consultant, agent, or agency, we collect business contact information and the information required for compensation and tax reporting, such as a Social Security Number or Federal Tax ID Number used to prepare IRS non-employee compensation forms.
  • Communications data: records and, where applicable, recordings of customer service calls, text and messaging history, conversations held through the chat feature on our Website (including any information you voluntarily provide during the conversation), and the date, time, and content of messages exchanged with us.
  • Device and usage data: IP address, browser type, operating system, device identifiers, approximate location, access times, pages viewed, and interactions with our Website, emails, and advertisements (including whether you open our emails, which links you click, and unsubscribe requests, collected through web beacons and tracked links in our emails), collected automatically through cookies and similar technologies (see our Cookies Policy).
  • Promotion data: information you submit when you participate in a contest, sweepstakes, survey, or other promotional activity.

We may supplement the information you provide with information lawfully obtained from public sources or third parties (for example, address verification services). You are not obligated to provide personal information, but declining to do so may prevent us from enrolling you in a plan or providing certain services.

1.1 Sensitive Personal Information

Certain information we collect may constitute sensitive personal information or sensitive personal data under applicable state law. We process such information only as permitted by applicable law and, where required, with consent. We do not use or disclose sensitive personal information for purposes other than those permitted under applicable law, and we do not sell sensitive personal information.

2. How We Use Personal Information

We use personal information to:

  • Create and manage memberships and accounts, process enrollments, payments, and renewals;
  • Provide the assistance services included in our plans, including coordinating funeral and repatriation services and related travel;
  • Communicate with you about your membership, payments, and service requests;
  • Administer corporate plans on behalf of participating employers;
  • Manage relationships with independent consultants, agents, and agencies, including commission payments and tax reporting;
  • Send marketing and promotional communications, where permitted and subject to your right to opt out;
  • Administer contests, sweepstakes, surveys, and other promotional activities;
  • Improve our Website, products, and services, and measure the effectiveness of our marketing;
  • Detect and prevent fraud, enforce our agreements, and collect amounts owed; and
  • Comply with legal obligations and respond to lawful requests from public authorities.

3. How We Disclose Personal Information

We do not sell personal information for monetary consideration. However, certain disclosures of personal information to advertising or analytics providers may constitute “sale,” “sharing,” or processing for targeted advertising under certain state privacy laws. You may exercise the opt-out rights described in Sections 7 and 8 and in our Cookies Policy.

We do not share mobile phone numbers or SMS opt-in consent with third parties or affiliates for their own marketing purposes. Text messaging originator opt-in data and consent are not shared with third parties.

We disclose personal information to the following categories of recipients, and only for the purposes described for each:

  • Service providers and processors — companies that process personal information on our behalf and under contract, solely to perform services for us and not for their own purposes: payment processing, banking, information technology and hosting, data storage and analytics, communications platforms (email, SMS, WhatsApp), customer relationship management (CRM) and email marketing providers that host our marketing database and send campaigns on our behalf, customer service, and marketing support.
  • Assistance service providers — funeral homes and funeral service providers in the United States and abroad, travel agencies, airlines, and repatriation partners, which receive the information necessary to deliver the specific services included in your plan when a service is requested.
  • Affiliates — our affiliated companies, including Plenitud Proteccion S.A. (Colombia) and Previsora Plenitud S.A. de C.V. (Mexico), which support the servicing of memberships, the management of our customer and marketing databases, and the delivery of assistance services, under obligations consistent with this Privacy Policy.
  • Independent consultants, agents, and agencies — which receive the contact information necessary to service the membership for which they are responsible. If you are an independent consultant in our program, we provide your sponsor and applicable upline consultants with the business contact and activity data necessary to administer the program.
  • Participating employers (corporate channel) — we may disclose information to participating employers only as reasonably necessary to administer the employer-sponsored plan, including eligibility, enrollment, billing, and related administrative matters, and subject to applicable law and contractual requirements. We do not disclose to employers the details of assistance services requested by a member’s family beyond what is necessary for those purposes.
  • Advertising and analytics providers — which receive online activity data through cookies and similar technologies in order to measure and deliver advertising, as described in Section 4 and in our Cookies Policy. These disclosures may constitute a sale, sharing, or targeted advertising under certain state laws, and you may opt out.
  • Legal and regulatory recipients — courts, regulators, and law enforcement, when required by law, subpoena, or court or administrative order, or when we believe disclosure is reasonably necessary to protect our rights or property, the rights of third parties, or public safety.
  • Collection and credit reporting agencies — if you fail to pay amounts owed, we may report account information to collection agencies and, where permitted by law, consumer credit reporting services.
  • Successors in a business transfer — in connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or part of our assets, personal information may be transferred to the successor organization, which will remain subject to this Privacy Policy or a successor policy of which you are given notice.

We may also disclose aggregated or de-identified information that does not identify you for any lawful purpose.

4. Cookies and Similar Technologies

We and our providers use cookies, pixels, web beacons, and similar technologies on the Website for site operation, analytics, and advertising. Our marketing emails also contain web beacons and tracked links that record opens, clicks, and unsubscribe requests, as described in our Cookies Policy. Some of these technologies involve the disclosure of internet activity data to advertising and analytics providers, which certain state laws treat as a sale, as sharing, or as processing for targeted advertising. Our Cookies Policy, which forms part of this Privacy Policy, identifies the technologies in use and how to exercise your choices, including through opt-out preference signals such as the Global Privacy Control (GPC) where required by applicable law.

5. Communications; Telephone, Text Message, and Call Recording

Service communications. We may contact you by telephone, text message, email, or mail regarding your membership, payments, and service requests. These communications are not promotional, and we may send them for as long as you hold a membership.

Marketing calls and text messages. Where you have provided the applicable consent, Assure for Life, its affiliates (including Plenitud Proteccion S.A.), and marketing and service partners acting on our behalf may send you marketing calls, voicemail messages, and text messages (SMS/MMS), including through an automatic telephone dialing system or a prerecorded or artificial voice. Providing a telephone number to us is not by itself consent to receive automated marketing calls or texts; that consent is obtained separately and expressly, and it is never a condition of purchasing any product or service or of participating in any promotion. Message frequency varies and message and data rates may apply.

Revoking consent. You may revoke consent to receive marketing calls or text messages at any time and by any reasonable means, including by replying STOP to any text message, telling our representative during a call, calling +1 (877) 927-7873, or emailing info@assureforlife.com. We will honor revocation requests as required by applicable law, including the rules of the Federal Communications Commission governing revocation of consent for calls and texts. You may opt out of marketing emails using the unsubscribe link in any marketing email. Opting out of marketing communications does not stop non-promotional, service-related communications about your membership.

Call recording. We may record calls for quality assurance, training, security, fraud prevention, dispute resolution, and compliance purposes, subject to applicable notice and consent requirements.

6. Your Choices

  • Access and update: members may review and update their information by logging into their online account, by contacting their consultant, agent, or agency, or by emailing info@assureforlife.com. Please notify us promptly when basic data such as your name, phone numbers, mailing address, or email address changes.
  • Marketing preferences: you may change your marketing preferences or unsubscribe at any time as described in Section 5.
  • Cookies and opt-out preference signals: you may control cookies through your browser settings and the tools described in our Cookies Policy.

7. Your State Privacy Rights

Your rights depend on the privacy law applicable to you, which is generally determined by your state of residence. The states listed in the table below have comprehensive consumer privacy laws in effect. The rights available, the exemptions that apply, and the thresholds that determine whether a business is covered are not identical across these states, and additional states may adopt or amend privacy laws over time. Where a state law applies to us and to you, we honor the rights it grants you.

Subject to the applicable state law and its exceptions, these laws generally provide some or all of the following rights: to confirm whether we process your personal information and to access it; to correct inaccurate personal information; to delete personal information; to obtain a portable copy of personal information you provided to us; to opt out of the sale of personal information, of sharing or processing for targeted advertising, and of certain profiling; to limit the use and disclosure of sensitive personal information or to require consent before it is processed, as provided by your state’s law; to appeal a denied request; and not to receive discriminatory treatment for exercising your rights.

How to exercise your rights. Email us at info@assureforlife.com with the subject line “Privacy Request,” call +1 (877) 927-7873, or write to Proteccion Plenitud, LLC (DBA Assure for Life), Attn: Privacy Manager, 100 N Federal Hwy, Suite 203, Hallandale Beach, FL 33009. We will verify your identity before responding, and you may authorize an agent to submit a request on your behalf. We will respond within the period required by applicable law. Depending on your state, the applicable period may differ, and certain laws permit an extension when additional time is reasonably necessary. If we decline to act on your request, you may appeal by replying to our response with the subject line “Privacy Appeal”; if your appeal is denied, you may contact your state Attorney General.

Opt-out preference signals. Where required by applicable law, our Website recognizes opt-out preference signals such as the Global Privacy Control (GPC) as a request to opt out of sale, sharing, and targeted advertising for that browser or device.

8. Additional Disclosures for California Residents

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (CCPA/CPRA), provides you with the rights described below, in addition to the general rights in Section 7:

  • Right to know and access — to request the categories and specific pieces of personal information we have collected about you, the categories of sources, the business or commercial purposes for collecting it, and the categories of third parties to whom we disclose it.
  • Right to delete — to request deletion of personal information we collected from you, subject to statutory exceptions.
  • Right to correct — to request correction of inaccurate personal information.
  • Right to opt out of sale or sharing — to direct us not to sell or share your personal information, including disclosures to advertising partners for cross-context behavioral advertising. You may exercise this right through the “Do Not Sell or Share My Personal Information” link on our Website or through an opt-out preference signal such as the GPC.
  • Right to limit the use and disclosure of sensitive personal information — to direct us to limit our use of sensitive personal information to the purposes permitted by law.
  • Right to non-discrimination — we will not deny goods or services, charge different prices, or provide a different level or quality of service because you exercised your rights.

Notice at Collection. At or before the point at which we collect personal information, we provide a notice identifying the categories of personal information to be collected, the purposes for which each category will be used, whether each category is sold or shared, and the length of time we intend to retain each category. That notice is available at the point of collection and at www.assureforlife.com/privacy-policy.

Authorized agents and appeals. You may designate an authorized agent to submit requests on your behalf, subject to verification. California residents may also request, once per year, a notice identifying the third parties with whom we have shared personal information for their direct marketing purposes (California “Shine the Light”).

We do not direct the Website to children, and we do not knowingly collect personal information online from children under 13. If we learn that we have collected personal information online from a child under 13 without verifiable parental consent, we will delete it promptly, consistent with the Children’s Online Privacy Protection Act (COPPA).

Minors covered by a plan. A membership plan may cover minor family members. An adult primary member may include them in the plan, and in that case we collect only the information needed to administer their coverage, such as name, date of birth, and relationship to the primary member. That information is provided by the adult member and is not collected online from the minor.

10. Information About Other Individuals

Where permitted by applicable law, if you provide personal information about another individual, you represent that you are authorized to provide that information and, where required, have provided that individual with appropriate notice of our privacy practices. Providing false information regarding the name, age, or relationship of persons included in a plan may result in the application of the remedies set forth in the membership plan terms and conditions.

11. Data Security

We maintain administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, alteration, and disclosure, including encryption of payment transactions in transit. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. Please notify us immediately at info@assureforlife.com if you believe your account credentials or payment information have been lost, stolen, or used without authorization. We will never ask you for your password in an unsolicited communication.

12. Data Retention

We retain each category of personal information for as long as necessary to fulfil the purposes described in this Privacy Policy, and thereafter for the period required to comply with legal, tax, accounting, and recordkeeping obligations, to resolve disputes, and to enforce our agreements. Where a specific retention period is not required by law, we determine it based on the nature of the information, the purpose for which it was collected, and applicable limitation periods. Usage data is generally retained for shorter periods unless needed for security or legal purposes.

13. Where Information Is Processed

Personal information may be stored and processed in the United States and, where necessary to provide our services or operate our business, in other countries, including Colombia and Mexico, where our affiliates and service providers operate and where data protection laws may differ from those of your jurisdiction. We take reasonable steps designed to ensure that such transfers are protected consistent with this Privacy Policy and applicable law. Our services are directed to residents of the United States; if you access the Website from outside the United States, you consent to the transfer and processing of your information as described.

14. Third-Party Websites and Social Media

The Website may contain links to third-party websites and may include social media features (such as share buttons) provided by companies including Meta (Facebook, Instagram, WhatsApp), Google (including YouTube), LinkedIn, X, and TikTok. These third parties may collect information about you when you interact with their features, and their handling of that information is governed by their own privacy policies, which we encourage you to review. This Privacy Policy applies only to information collected by Assure for Life.

15. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or for operational, legal, or regulatory reasons. The current version, with its effective date and the date it was last updated, will always be posted on the Website. If we make material changes, we will provide additional notice as required by applicable law. Your continued use of the Website after the revised Privacy Policy becomes effective does not affect any rights you may have under applicable law.
